Opening of proceedings
The Grand Ruling Chamber for Energy of the Bundesnetzagentur has split the proceedings opened on 17 October 2024 for the determination of a methodology for the future design of efficiency benchmarking for electricity distribution system operators and gas distribution and transmission system operators [GBK-24-02-3#5] into two separate proceedings for the electricity and gas sectors .
The Grand Ruling Chamber for Energy thus opened proceedings for the determination of the methodologies for carrying out efficiency benchmarking for electricity distribution system operators (“electricity efficiency benchmarking”; GBK-25-02-1#2) in accordance with section 29(1) in conjunction with sections 21 and 21a of the Energy Industry Act (EnWG) on 30 June 2025.
It was necessary to look at a number of different provisions for electricity distribution system operators on the one hand and gas distribution and transmission system operators on the other, in particular because of the challenges in the electricity sector caused by the energy transition and the ongoing transformation of the gas sector. In the process of drawing up the draft determination, it became clear that it was expedient to have two separate proceedings, one for the electricity and one for the gas sector. This will make it easier to amend the determinations in future for the specific sector. With the exception of the differing provisions, the aim of a largely uniform regulatory framework for electricity distribution system operators and gas distribution and transmission system operators remains.
The responsibility of the Grand Ruling Chamber derives from section 59(3) sentence 2 in conjunction with section 54(3), section 21 and section 21a EnWG.
The contents of the proceedings with the reference GBK-24-02-3#5 will continue as planned. The entire contents of the file for GBK-24-02-3#5 will be transferred to the proceedings for electricity distribution system operators (electricity efficiency benchmarking, GBK-25-02-1#2). The proceedings previously known as GBK-24-02-3#5, as far as they concerned electricity distribution system operators, are thus merged into the proceedings for electricity distribution system operators (electricity efficiency benchmarking, GBK-25-02-1#2). At the same time, the proceedings GBK-24-02-3#5 will be discontinued. Previous notifications about the GBK-24-02-3#5 proceedings may still be accessed here.
