The EMC Directive is to enable the free movement of electrical equipment and EU-wide guarantee sufficient protection against electromagnetic interference.
Since 1992, the application of the EMC Directive has gained rich experience. In 1997, the Commission published in cooperation with national authorities and other interested parties a non-binding guideline. The guide has contributed significantly the uniform application of the EMC regulations, but could not solve the problem of non-binding character.
As part of the SLIM process (simpler legislation for the internal market) the EMC Directive has been completely revised during 2004/2005 and was published as the new EMC Directive (2004/108/EC) on 31.12.2004 in the Official Journal of the European Union ( L390 / 4). The new EMC Directive is in force since 20.01.2005 and had to be implemented by Member States into national law until 20.07.2007.
The old EMC Directive 89/336/EEC is repealed by 20.07.2007. The transitional period ended on 20.07.2009. Until 20.07.2009 it was possible to place equipment on the market in line with old EMC Directive 89/336/EEC.
