Frequencies for 5G - Key Elements and Identification of Demand

The Bundesnetzagentur, on the basis of the responses to the Points of Orientation (see below) consultation paper, has now drawn up key elements. These take the Points of Orientation forward. At the same time the Bundesnetzagentur is starting a process to identify demand for nationwide assignments in the 2 GHz and 3.6 GHz bands.

The Bundesnetzagentur is therefore issuing a call for notification of frequency requirements for the 2 GHz and 3.6 GHz spectrum provided nationwide. Stakeholders are invited to submit their views on the key elements and to notify their frequency requirements by 30 September 2017.

Mobile Broadband - Project 2016

The Award of spectrum in the 700 MHz, 900 MHz, 1800 MHz and 1.5 GHz bands for mobile/fixed communications networks will start on 27 May 2015. The spectrum auction was preceded by a qualification procedure to check that the legal requirements for admission to the auction had been fulfilled. The following companies were today admitted to the auction:

  • Telefónica Germany GmbH & Co. OHG
  • Telekom Deutschland GmbH
  • Vodafone GmbH

Merger of E-Plus and Telefónica

In connection with the European Commission’s approval under competition law of the merger between the mobile operators Telefónica Deutschland and E–Plus the Bundesnetzagentur has published a decision on the frequency regulation aspects of the merger, in accordance with section 55(7) and (8) of the Telecommunications Act (TKG).

The decision specifies the following measures:

  • return of 900/1800 MHz spectrum by Telefónica / E-Plus before the expiry date of 31 December 2015 and close in time to reallocation of the so-called GSM spectrum (Project 2016)

in conjunction with

  • a subsequent examination of the post-merger spectrum distribution in light of all known facts (most notably the 900/1800 MHz reallocation).

Flexibilisation Of Frequency Usage Rights and Frequency Award 2010

The Bundesnetzagentur President's Chamber decision of 12 October 2009 on the flexibilisation of frequency usage rights in the bands at 450 MHz, 900 MHz, 1800 MHz, 2 GHz and 3.5 GHz (Ref BK1a-09/001) lifts unnecessary restrictions on the assigned frequency usage rights, allowing the network operators to use the frequencies on request on a technology-neutral basis for wireless access for the provision of telecommunications services.

Those frequencies auctioned between 12 April 2010 and 20 May 2010 from the 800 MHz, 1.8 GHz, 2 GHz and 2.6 GHz bands on the basis of the President's Chamber decision of 12 October 2009 (Ref BK1a-09/002) were also assigned in a technology-neutral manner.

These decisions take account of development in telecommunications markets, which are characterised by an increasing convergence of services and technologies, the merging of hitherto separate markets, a rapidly growing demand for broadband access to telecommunications networks and extensive flexibilisation of frequency regulation.
