Ad­vi­so­ry Coun­cil

Tasks

The Advisory Council has the following tasks:

  • It submits proposals to the federal government for the appointment of the President and two Vice Presidents of the Bundesnetzagentur (section 3(3) of The Bundesnetzagentur Act).
  • It is involved in the Bundesnetzagentur's decision-making in accordance with section 100(4) paras 2 and 4 of the Telecommunications Act (TKG), for which consultation with the Advisory Council is required.
  • It is entitled to request measures aimed at implementing the regulatory objectives and safeguarding the right to be supplied with telecommunications services as set out in Part 9 TKG; the Bundesnetzagentur is obliged to respond to the request within six weeks (section 194(3) TKG).
  • It is entitled to request information and opinions from the Bundesnetzagentur; the Bundesnetzagentur is obliged to provide the information and opinions requested (section 194(4) TKG).
  • It must be consulted when the Spectrum Plan in accordance with section 90 TKG is drawn up (section 120(5) TKG).
  • It is involved in the Bundesnetzagentur's decision-making in accordance with sections 13 and 14 of the Postal Act (PostG), for which consultation with the Advisory Council is required in imposing and tendering for postal universal services (section 46(2) PostG).
  • It advises the Bundesnetzagentur in the preparation of the reports referred to in section 63(3) of the Energy Industry Act (EnWG); it is entitled to request information and opinions from the Bundesnetzagentur, and the Bundesnetzagentur is obliged to provide the information and opinions requested.

Members

In accordance with section 5(1) of The Bundesnetzagentur Act, the Bundesnetzagentur's Advisory Council comprises of

  • 16 members from the German Bundestag
  • 16 representatives from the German Bundesrat

The German Bundesrat representatives must be members or political representatives of a federal state government. The members and deputy members are each proposed by the German Bundestag or German Bundesrat and appointed by the federal government.

Meetings
