About the Grand Ruling Chamber for Energy
The amended Energy Industry Act (EnWG), which came into force at the end of 2023/beginning of 2024, provides for the establishment of a “Grand Ruling Chamber for Energy” at the Bundesnetzagentur [section 59(3) EnWG (German)].
The legal provisions restrict the area of responsibility to the rules under sections 20 to 23a, sections 24 to 24b and section 28o(3) EnWG.
The Grand Ruling Chamber for Energy issues nationally applicable determinations on the conditions and methods for network access and for determining the tariffs for network access, including cost and incentive regulation.
The Bundesnetzagentur will create the regulatory framework with nationally applicable determinations in consultation with the Committee of representatives of the federal state regulatory authorities [section 54(3) sentence 4 EnWG]. This ensures effective involvement of the regulatory authorities of the federal states. Each determination by the Grand Ruling Chamber is issued by a body comprising the President and Vice Presidents together with three other members of the Grand Ruling Chamber, one of whom will be designated as rapporteur.
The Grand Ruling Chamber may delegate determinations within its area of responsibility to one of the other ruling chambers.
