Bundesnetzagentur issues determination on market integration of electricity storage facilities and charging points (MiSpeL)

The Bundesnetzagentur has today issued the determination on the market integration of electricity storage facilities and charging points (MiSpeL).

It will activate countless large and small electricity storage facilities as well as charging points for the electricity system. This will enable millions of interested households to shape the energy transition proactively,

Improvement in the market integration of storage facilities and charging points
Up to now, green electricity and electricity from the grid have had to be strictly separated in storage facilities. Only storage facilities using exclusively green electricity could receive support under the Renewable Energy Sources Act (EEG). Bidirectional charging points used both for charging electric vehicles and for feeding electricity from the cars back into the grid, in a similar way to electricity storage facilities, were excluded. The MiSpeL determination overcomes these rigid boundaries. Prosumers and companies active in the market can use their electricity storage facilities and charging points to their own advantage, helping the electricity market and, at the same time, the integration of renewable energy.
Electricity storage facilities and bidirectional charging points can be used to improve flexibility on the demand side (electricity consumption with dynamic tariffs) and on the supply side (price-optimised direct marketing). Prosumers, businesses and industry with the ability to respond flexibly benefit from lower electricity costs if they consume electricity at times when market prices are low (and renewable electricity generation is high). By shifting their feed-in (from renewable energy installations and storage facilities) to periods when market prices are high, they can achieve higher revenue.
The MiSpeL determination opens up these options both for electricity storage facilities and bidirectional charging points, which are treated the same as far as possible.
Under the new MiSpeL rules, the EEG support is maintained and is also paid for “temporarily stored” renewable electricity. Further advantages are envisaged for "temporarily stored” electricity previously taken from the grid, namely, that fewer levies and network tariffs have to be paid for the withdrawal from the network because the volumes “fed back” into the grid are netted. MiSpeL sets out how these volumes of electricity that can receive pro rata support and netting are calculated.
The determination presents two options. The separation option is open to all users and enables the electricity volumes to be calculated precisely. The formulae for this option generally envisage two meters for the separation to work correctly but, in special cases, one is sufficient. The flat-rate option is a simpler alternative for households with solar panels of up to 30 kilowatts of peak power. The flat-rate calculation means that only one meter is usually required for this option.
Consultation
The Bundesnetzagentur has accepted many helpful suggestions from the consultation. The additions enable, among other things, the MiSpeLrules to be used not only for supported renewable installations but also for those that do not receive support and even without generating electricity. Simplified formulae for special cases were also added. The determination accedes to the desire of the market to regulate as many use-cases of storage facilities as possible as precisely as possible. Despite the numerous use-cases to regulate and the corresponding complexity, MiSpeL offers a pragmatic, digital solution with maximum freedom for innovation and clear guidelines against abuse.
The determination includes a transition period until September 2027 for network operators and meter operators to carry out their implementation. During the transition period, it is possible to apply the determination with the agreement of the network operator and meter operator. The application of the flat-rate option has to wait for the European Commission to approve the legal basis in light of State aid rules.
